The homeowner contacted me and we met to see his house and learn about his situation. He was 4 months behind in his mortgage payments and did not know just how close he was to losing his home. A week before we closed, the owner received the dreaded foreclosure notice of default and the auction date to publically sell his house was 6 weeks away.
At closing the following week, I paid the mortgage company the 4 months back payments plus interest, penalties, fees, and attorney fees for the foreclosure (this amounted to thousands of dollars). I stopped the foreclosure. My agreement with him when I acquired his home was a 2 step process. I gave the homeowner cash at closing, and I continued making his mortgage payments with what is called a Subject to (subject to the underlying mortgage). Southern Homes Investments bought the home with a Deed of Title but the mortgage remained in the owner’s name. I, as the investor, paid the monthly mortgage payments in full each month and on time.
What is really important is by me making the mortgage payments in the name of the previous owner, I slowly rebuilt his credit. This is a huge benefit and one great reason to use a Subject to! Had the owner not been saved from foreclosure, he would have lost his house at public auction and his credit rating would have taken a huge 100+ point hit. It would have taken him up to 3 years or more to overcome the credit loss to foreclosure.
